Gun Raffle TERMS AND CONDITIONS

 

Ninety Sixers Motorcycle Club Glock 43X Raffle

 

Effective date: 12/15/2025

 

These Terms and Conditions govern the Ninety Sixers Motorcycle Club Glock 43X raffle (the “Raffle”). By purchasing or receiving a raffle ticket and/or entering the Raffle, you agree to be bound by these Terms and Conditions and all applicable laws.

 

1) Sponsor and Eligibility

 

- Sponsor: Ninety Sixers Motorcycle Club (“Sponsor”).

- Eligibility: -----

  - Must be 21 years of age or older at the time of entry.

  - Must possess a valid Illinois Firearm Owner’s Identification (FOID) Card at the time of entry and prize claim.

  - Must be legally permitted under all federal, state, and local laws to purchase, receive, and possess a firearm.

  - Residency: Open only to individuals legally eligible to complete transfer with a licensed Federal Firearms Licensee (FFL) in Illinois. Void outside Illinois and where prohibited by law.

- Ineligible individuals:

  - No member of the Ninety Sixers Motorcycle Club is eligible to win.

  - No immediate household family member of a Ninety Sixers Motorcycle Club member is eligible to win. “Immediate household family” means persons who share the same residence for at least three months of the year.

 

2) How to Enter:   Tickets

 

- Ticket sales channels, quantities, and prices will be posted on the Sponsor’s Facebook page and website.

- Number of entries per person: Unless otherwise stated in promotional materials, no limit.

- Tickets are non-transferable once issued and may not be resold.

- All sales are final; no refunds or exchanges except as required by law.

- Raffle may be subject to local permitting/licensing requirements. Void where prohibited.

 

3) Prize Details

 

- Prize: One (1) Brand New Glock 43X pistol (exact Gun model/finish/configuration is pictured in raffle ticket). Brand New Slide, Frame, and components. 

- No cash alternative or substitution is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason beyond Sponsor’s control.

- Accessories, ammunition, holsters, cases, and any items not expressly stated are not included.

 

4) Fees, Taxes, and Winner Responsibilities

 

- Winner must pay all transfer fees, background check fees, shipping (if applicable), use/sales taxes, and any other fees or taxes associated with accepting and transferring the prize.

- Winner is solely responsible for complying with all federal, state, and local laws and regulations, including completing all required forms and verifications.

 

5) Background Check, Transfer, and Verification

 

- The prize will be transferred only through a licensed Federal Firearms Licensee (FFL) in compliance with all federal, state, and local laws.

- Winner must:

  1. Present valid, government-issued photo identification.

  2. Present a valid Illinois FOID Card.

  3. Successfully complete the required federal NICS background check (or Illinois equivalent).

  4. Complete ATF Form 4473 and any other required paperwork.

- The name on the winning ticket must match the transferee’s identity documents. No straw purchases are permitted.

- If the winner fails any background check, refuses or is ineligible to complete the transfer, or does not meet legal requirements, the winner will be disqualified, will forfeit the prize, and an alternate winner will be selected.

 

6) Drawing; Date; Location; Broadcast

 

- The drawing will take place five (5) days after all 150 tickets are sold.

- The drawing date will be posted on the Sponsor’s Facebook page and on the Sponsor’s website.

- The live drawing will be conducted via Facebook Live on the Sponsor’s Facebook page.

- Winner need not be present to win.

- Odds of winning depend on the total number of eligible tickets purchased.

 

7) Winner Notification and Claiming the Prize

 

- Winner will be notified by phone and/or email within 48 hours of the live drawing.

- The winner must claim the prize within 14 days of the drawing date by following the instructions provided in the notification (including coordinating with the designated FFL).

- Failure to claim the prize within 14 days, failure to respond, inability to verify eligibility, or failure to complete the transfer process will result in forfeiture, and another drawing will take place to select an alternate winner.

 

8) Disqualification

 

- Sponsor may disqualify any individual for:

  - Providing false, fraudulent, or misleading information.

  - Tampering with the entry process or the Raffle.

  - Engaging in conduct that undermines the fairness or integrity of the Raffle.

  - Chargebacks, payment reversals, or ticket resale.

  - Violating these Terms and Conditions or applicable law.

 

9) Release and Limitation of Liability

 

- By entering, entrants release the Sponsor, its affiliates, officers, members, volunteers, and agents from liability for loss, damage, or injury related to participation or accepting the prize, to the fullest extent permitted by law.

- Entrants acknowledge that firearm ownership and handling carry inherent risks and agree to assume all risks associated with possession, use, storage, and transport of the prize.

- Sponsor is not responsible for technical issues, lost/late/misdirected entries, broadcast interruptions, force majeure events, or any acts beyond its reasonable control.

 

10) Publicity

 

- Except where prohibited by law, by entering, the winner consents to the Sponsor’s use of the winner’s name, city, likeness, and statements for promotional purposes in any media, without additional compensation or notice.

 

11) Privacy

 

- Personal information collected will be used to administer the Raffle, to communicate with entrants, and as otherwise described in Sponsor’s posted privacy practices (if any). Sponsor will not sell entrant data and will only share data with third parties (e.g., FFL) as required for prize fulfillment or as required by law.

 

12) Compliance with Laws

 

- The Raffle is subject to all applicable federal, state, and local laws and regulations, including ATF regulations and Illinois firearms laws.

- Void where prohibited, taxed, or restricted by law. If any provision is inconsistent with applicable law, that provision is deemed modified or severed to the minimum extent necessary to comply with law.

13) General Conditions

 

- Sponsor’s decisions regarding eligibility, compliance, and winner selection are final and binding.

- Sponsor reserves the right to modify, suspend, or cancel the Raffle, or to amend these Terms and Conditions, if fraud, technical failures, legal or regulatory requirements, or any other factor impairs the integrity or proper functioning of the Raffle.

- In the event of cancellation prior to drawing, Sponsor may provide refunds or alternative remedies as required by law; otherwise, all sales are final.

- If any provision is held invalid, the remaining provisions remain in full force.

- No waiver of any term shall be deemed a further or continuing waiver of such term.

 

14) Non-Affiliation and Platform Notices

 

- This promotion is in no way sponsored, endorsed, administered by, or associated with Glock, Inc., Facebook, or Meta Platforms, Inc.

- Any references to Glock are for prize identification only. Glock’s trademarks are the property of their respective owner.
